Assignment overview

The purpose of this assignment is for you to apply the knowledge you have gained this far on a scenario-based project case analysis. You will be given a number of questions, however, you will need to answer them in the form. of an essay addressing the different issues in the brief. Yes or no answers to the questions are not acceptable. Please explain each of your answers with reference to the appropriate documents in the Appendix.

This assignment supports course learning outcomes 2, 3 and 4.

Assignment details

Scenario

Mr Jordan Smith had always dreamed of cycling in the Tour de France. However, he chose to pursue engineering instead. Fortunately, Jordan became a successful mechanical engineer.

Jordan was successful but not fulfilled. He remembered his childhood dream of cycling through the French countryside. So, he started cycling to and from his engineering firm. Using his engineering knowledge, he began tinkering with his bicycle and eventually started building bicycles. His passion took off and he left his engineering career to create a bicycle manufacturing company, Velocycle Limited (Velocycle).

Beginning out of Jordan's garage, Velocycle was a huge success. In 2020, Velocycle opened its first factory and store in Onehunga, Auckland. Despite a struggling economy, Velocycle continued to grow due to public transport woes and the public’s growing environmental awareness. In 2024, Velocycle is looking to expand by opening a second factory and store in Wairau Valley on the other side of Auckland.

Jordan's company, Velocycle, had just gone through the process of building a large factory in Onehunga and the Development Manager, Ms Nikki Comer, had a good idea of the scope of work and scale of the factory and shop development in Auckland.

During the course of this project, four issues were encountered. The following tables show these issues.

 

Assume for the purpose of issues three and four that the Appendix B tender package was sent.

 

Task

Step 1: Ensure you have studied the scenario of Velocycle carefully.

Step 2: Answer the following questions.

Issue one

What do you consider is the best delivery model for this project? Please explain your answer with reference to the nature of the project, the risk, and the division of responsibility. (6 marks)

What types of contract pricing options could be used by Velocycle for this project, and which one would you recommend? Give reasons for your explanation. (6 marks)

Issue two

What are the risks associated with Jordan using the cover note in Appendix A? (4 marks)

In what circumstances would it be suitable to use the cover note in Appendix A? (2 marks)

Which cover note should Jordan choose for his tender process? (2 marks)

Issue three

What are the issues arising from this scenario? (4 marks)

Issue four

Explain the requirements for a valid and enforceable contract. (2 marks)

Does a contract exist between Velocycle and MDGfor the project? What date did the contract come into existence? Explain your reasoning. (4 marks)
